The Employer's Ethical And Legal Responsibilities for Working From Home

Working from home, telecommuting became a requirement with the advent of the current pandemic. The biggest surprise was that many were able to continue to be productive, even though they were not in the office. Some organizations were able to arrange their receptionists, the front face of their organizations, to work from home.


As time progresses and we get the upper hand on COVID-19, work will undoubtedly return to some semblance of pre-pandemic normal. The expectation though is not everyone will need to return to the office.


So, what are the employer’s responsibilities to their employee when they do not control the workspace?
This panel discussion will explore the legal and ethical responsibilities employers have to their employees in a telecommuting arrangement.

Linda Miller

Linda Miller (OT(C), OTD, MEDes, CCPE, CPE) is President and Certified Occupational Therapist/Ergonomist at EWI Works International Inc. in Edmonton. Linda established EWI Work in 1991 with the goal to provide education and consulting services to employers in order to prevent workplace injury and improve employee performance.

In the early years the focus was on in-person training and consulting, but in the past five years the Corporation has been expanding into software tools to manage programs, training and telehealth consulting.  The organization specializes in government, healthcare, utilities, forestry, mining, food processing and manufacturing program development.  

​

For three decades, Linda has presented at health & safety conferences and teaches regularly at the University of Alberta where she holds an appointment in the Faculty of Medicine in the Division of Preventive Medicine and the Faculty of Rehabilitation Medicine in the Department of Occupational Therapy. 

​

She is also currently the Chair of the Board for the Edmonton Public School Foundation.

Dave Foster

David’s practice consists of labour, employment, occupational health and safety (“OHS”) and civil litigation. He enjoys working with both individual and commercial clients in order to find the appropriate resolutions to their legal issues. He has previous experience in the field of discretionary investment for high net worth clients.

 

David has appeared in the Alberta Court of Appeal, the Alberta Court of Queen’s Bench and the Provincial Court of Alberta dealing with such matters such as OHS, wrongful dismissals and estate litigation.

 

He has also appeared before the Alberta Labour Relations Board.

 

In the area of OHS, he has dealt with discriminatory actions complaints, OHS Order compliance, witness interviews and litigation.

Bob Stenhouse

Bob Stenhouse is the Principal Director and foungder of Veritas Solutions, a boutique workplace investigations and psychological safety training firm that provides risk management, education, and investigations services to clients across Alberta and Western Canada. He is a former decorated RCMP undercover, organized crime fighter, homicide investigator (great stories!) and leader of the Corporate Investigations Unit for Alberta Health Services (largest employer in Alberta) with responsibility to investigate and resolve the highest risk and complex workplace investigations.

He is also a Certified Psychological Health and Safety Advisor and Trainer and Certified Emotional Intelligence assessor and facilitator.
